Proposed Amendments to the “Modified Standard Rules and Regulations in the Operation of Waterworks System”

Since the last modification of the Standard Rules and Regulations in the operation of waterworks system in 2008 pursuant to Res. No. 019-0508, there are changes that need to be incorporated especially with the issuance of NWRB Resolution No. 25-0818 on the adoption of the NWRB Economic Regulatory Framework (“Revised Tariff Methodology – 2018”) and NWRB Resolution No.30-0619 on the Policy Guidelines on the Submission of Annual Report. Service standards also have to be upgraded.  The proposed amendments to the modified standard rules and regulations in the operation of waterworks systems embody these latest developments and incorporates the comments/suggestions gathered during the stakeholders’ consultation held on January 31, 2020.

Modified Standard Rules and Regulations in the Operation of Waterworks System Modified Standard Rules and Regulations in the Operation of Waterworks System, as Amended
1 That applicant shall operate the waterworks system in such condition as will enable it to render efficient, adequate and continuous service.  For this purpose, adequate and continuous service shall mean provision of at least 100 liters per capita daily consumption and regular service of at least 8 hours per day. The CPC Grantee shall operate the waterworks system in such condition as will enable it to render efficient, adequate and continuous service.  For this purpose, adequate and continuous service shall mean provision of water supply service of at least 18  hours per day and at least 110 liters per capita per day (lpcd) with a pressure of not < 8 psi_(for industrial zones, 25 psi)
2 That Applicant shall adhere strictly to the schedule of rates approved by the Board and shall not alter the same without previous approval from the Board. The CPC Grantee shall adhere strictly to the schedule of rates approved by the Board and shall not alter the same without prior approval by the Board.
3 That Applicant shall operate and maintain a waterworks system within ____________ only in accordance with the approved plans and specifications and shall render service only within the territory defined and shall not suspend or abandon operation without approval from the Board. The CPC Grantee shall operate and maintain a waterworks system within the authorized area of operation as defined under their respective certificates of public convenience and in accordance with the approved plans and specifications. It shall not suspend or abandon operation without prior notice and approval of the Board, except in cases of force majeure; provided however, that the water service operator concerned shall undertake to restore water supply operation to its normal level or operating condition as soon as possible.

That the water supplied by Applicant-Operator to its customers must be chlorinated. 

That the water supplied by CPC Grantee to its customers must be chlorinated, except for industries requiring raw water. The chlorine shall not be directly applied to the deepwell.

That Applicant shall secure every month a certificate from a proper government agency that the water supplied to its customers is potable and good drinking purposes.  The said Water Quality Report shall be submitted to NWRB every month.

The CPC Grantee shall submit every year to NWRB a copy of the recent Certificate of Potability issued by the City/Municipal Health Officer together with the physical-chemical and bacteriological test results from DOH accredited laboratories. Notwithstanding therewith, the CPC grantee shall also submit to the NWRB the bacteriological test results conducted every month and the physical-chemical test results conducted every year per source.

That Applicant shall submit to the Board on or before May 30th of every year an Annual Report of finances and operation of its waterworks system for the previous year, in the Annual Report Form prescribed the Board.

The CPC Grantee shall submit to the Board every year on or before the 30th of May an Annual Report of finances and operation of its waterworks system for the preceding year, in the annual report form prescribed by the Board. Non-submission or failure to submit the said report on or before the date as herein set,  a penalty of P10,000 shall be imposed thereof. The same penalty shall apply for submission of annual report with   erroneous, incomplete, or inaccurate data/information.

That Applicant shall pay supervision and regulation fee on or before September 30th of every year, computed at the rate of P0.50 for every P100.00 or fraction thereof of the capital invested in the waterworks system finances and operation.

The CPC Grantee shall pay a Supervision and Regulation Fee on or before the 30th of September every year, computed at the rate of P0.50 for every P100.00 of the capital stock subscribed or paid, or of the capital invested, whichever is higher.

That Applicant shall install Board calibrated/sealed water meter to all its service connections to insure accuracy of measuring water consumption within sixty (60) days from approval thereof and said water meters shall be re-calibrated and sealed by the Board every two years. 

That CPC Grantee shall install Board tested and sealed water meter individually to all its service connections to ensure accuracy in the measurement. The water meters shall be re-tested and sealed by the Board every two years. Further, that the water service provider shall submit a complete list of installed water meters within its service area every year together with the Annual Report of finances and operation of its waterworks system.

That Applicant shall set aside annually a provision for sinking fund in accordance with the National Water Resources Board Memorandum Circular No. 1, series of 1986 dated December 12, 1986. (not applicable for waterworks operation using ROI method).

That Applicant shall observe and comply, and shall be responsible for the observance and compliance by its employees and agents, with all the rules and regulations of the Board relative to the operation and maintenance of waterworks system, as well as those that may be promulgated from time to time.

The CPC Grantee shall be fully responsible with the compliance of all the rules and regulations of the Board relative to the operation and maintenance of waterworks system.

Non-compliance shall be subject to the penal sanctions for CPC violators as provided for in the Public Service Law.

That the Certificate of Public Convenience herein granted shall be valid for a period of five (5) years counted from approval. (Unless a longer period is granted)

The CPC shall be renewed at least one (1) year prior to the date of expiration. However, should the Certificate of Public Convenience has already expired without having been renewed as herein prescribed, a penalty for operating a waterworks system without a CPC shall be accordingly imposed. Appropriate order for the cessation in the operation shall be issued.
