WHEREAS, NWRB Res. No. 15-0719 issued during the 192nd Meeting of the Board on July 31, 2019 sets the policy on streamlining and process improvement of NWRB’s frontline services in compliance with RA  11032, otherwise known as the “Ease of Doing Business and Efficient Government Service Delivery Act 0f 2018”;

WHEREAS, there is a need to issue a Provisional Authority and Provisional Water Rates for Certificate of Public Convenience (CPC) and other related applications to be able to conform with the 20-working-day processing time for highly technical applications in compliance with RA 11032;

WHEREAS, the 20-working-day issuance of Provisional Authority shall be reckoned from the date of compliance with the jurisdictional requirements;

WHEREAS, the Provisional Authority is the authority granted to a qualified applicant for Certificate of Public Convenience to operate and maintain a waterworks system and to charge rates therefor;

WHEREAS, the Provisional Water Rate is the temporary water rates issued by NWRB to applicants/petitioners for CPC to be used as basis to compute or calculate water charges for a monthly or any regular billing cycle pending issuance of the final or approved water tariff;

NOW THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED, that  the Provisional Authority shall be valid for six (6) months from the date of issuance/approval and is extendable for another six months depending on the necessity unless otherwise modified, cancelled, revoked, or extended;

RESOLVED FURTHER, that the rates to be initially adopted under the Provisional Authority shall be the proposed tariff of the water service provider, unless upon initial review of the documents and other data filed/submitted by the same water service provider, the NWRB technical staff shall have determined that a considerably lower rate should be issued;

RESOLVED FURTHERMORE, that a refund for whatever excess payment arising from or as a result of the issuance of Provisional Water Rates shall be given to the customers by way of credit to individual accounts on a monthly basis or according to the billing cycle, as the case may be, equivalent to the number of months or billing cycles that the water consumers were overcharged as a result of the Provisional Water Rates issued;

RESOLVED FINALLY, that the Provisional Authority and/or Provisional Water Rates shall be automatically revoked upon the issuance of the CPC.
