PROPOSED GUIDELINES ON THE IMPLEMENTATION OF BOARD RESOLUTION NO. 15-0719 ENTITLED “POLICY ON STREAMLINING AND PROCESS IMPROVEMENT OF NWRB’s FRONTLINE SERVICES”

WHEREAS, during the 192nd Board Meeting on July 31, 2019, the Board issued Resolution No. 15-0719 entitled “Policy on Streamlining and Process Improvement of NWRB’s Frontline Services in Compliance with R.A. 11032”;

NWRB Resolution No. 15-0719 provides that in order to conform with the allowable processing time for the highly technical applications, the streamlined process shall apply for the issuance of Conditional Water Permit (CWP) in lieu of the issuance of Water Permit and the issuance of Provisional Authority in lieu of the issuance of Certificate of Public Convenience (CPC);

WHEREAS, the said Board Resolution was formulated in compliance with relevant provisions of the Implementing Rules and Regulations of R.A. 11032 which are non-specific and may cause misperception particularly under Rule XIII, Section 1(a), to wit:

  1. Refusal to accept application or request with complete requirements being submitted by an applicant or requesting party without due cause;

WHEREAS, the issuance of Water Permit and Certificate of Public Convenience involve multi-stage processes and require different set of documentary requirements;

WHEREAS, the development of guidelines is necessary for the effective implementation of the said policy, notwithstanding the existing Board policies relative to the processing of CWP/WP and CPC applications and the corresponding penalties that shall also apply;

NOW THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED, to adopt the following guidelines on the acceptance of applications on Water Permit and CPC:
